Nurse Practitioner Sues West Virginia Medical Center for Alleged Wrongful Termination

Lawsuit cites alleged unlawful termination of employment.

Nurse practitioner Julia Skaggs Sears is suing Kanawha County medical care providers for alleged retaliation and unlawful termination.

The lawsuit was filed by the plaintiff on September 12, 2016, against Charleston Area Medical Center Inc (CAMC), Kelly Medical Services LLC (Teamhealth Atlantic), and Teamhealth South, according to theWest Virginia Record.

Sears alleges that CAMC tortuously interfered with her contractual employment relationship with Teamhealth, the report noted. Furthermore, her employment had been terminated after she reported the unsafe condition that CAMC had created in its emergency room in June 2016, according to theRecord.

As a result of the termination, the complaint states that Sears suffered lost benefits and wages, embarrassment, emotional distress, and other non-pecuniary losses. She is currently being represented by attorneys Lia DiTrapano of DiTrapano Law Firm PC and Tom L. Price of Tom Price Law PLLC.

Sears will seek trial by jury, compensatory damages, punitive damages, pre- and post-judgment interest, costs of litigation, and all other relief, theRecordreported.

Currently, Charleston Area Medical Center is being sued by a different unrelated party for the allegednegligence that led to the death of the plaintiff’s husband.
